Fatal Austin shooting death of Franklin Earl Miller – Obituary

In a recent update, the Austin Police Department has released details about the shooting that occurred on the night of September 10 in north Austin. The deceased has been identified as Franklin Earl Miller, a 59-year-old man.

 

The incident unfolded around 10:59 p.m. when a call was made to Austin 911 reporting that Miller was attempting to break into a business located at 1724 West Anderson Lane. The caller, who was monitoring the situation through security cameras, observed Miller with a rock and possibly a gun in his waistband.

 

When officers arrived on the scene at approximately 11:11 p.m., they encountered Miller, who did not comply with their instructions. Despite ongoing de-escalation attempts, Miller was seen holding a pistol and refusing to disarm. Around 11:25 p.m., he raised the firearm towards the officers, prompting them to use their department-approved weapons. Immediate life-saving measures were performed, but Miller was pronounced dead at 11:33 p.m. by Austin-Travis County EMS.

 

Five officers discharged their firearms during the confrontation, with their tenures ranging from four months to six and a half years. Additionally, a sixth officer used a pepperball launcher. This officer has four months of service.

 

The Austin Police Department is conducting two investigations into the incident: a criminal investigation led by the APD Special Investigations Unit in cooperation with the Travis County District Attorney’s Office, and an administrative investigation by the APD Internal Affairs Unit with oversight from the Office of Police Oversight. Body-worn camera footage of the incident will be released within ten business days.
