Fatal North Austin police shooting death of Franklin Earl Miller – Obituary

Authorities have named Franklin Earl Miller as the individual fatally shot by police in North Austin earlier this month. On September 10, at approximately 11 p.m., officers responded to a 911 call from a business owner who reported witnessing an attempted burglary via surveillance footage. The footage showed Miller, 59, pulling on the doors of Yadis Nails located at 1724 West Anderson Lane, and holding a rock. The business owner also noted that Miller had a gun in his waistband.

 

When officers arrived at the scene at 11:11 p.m., they saw Miller making erratic movements and instructed him to raise his hands, but he did not follow their commands. About nine minutes later, Miller was seen holding a pistol. Police urged him to drop the weapon.

 

During a press briefing on September 11, Police Chief Lisa Davis stated that officers attempted to de-escalate the situation by repeatedly telling Miller to drop the gun and show his hands. One officer deployed a pepper ball in an effort to persuade Miller to surrender. After nearly 15 minutes of attempts to disarm Miller, he pointed the gun at the officers, prompting them to respond. At approximately 11:25 p.m., five officers discharged their weapons at Miller.

 

Following the shooting, the officers initiated life-saving measures, which were later taken over by Austin-Travis County EMS. Miller was pronounced dead at 11:33 p.m.

 

There were no injuries reported among the officers or the public. The five officers involved had between four months and 6½ years of service at the time. Body camera footage of the incident will be released on the 10th business day following the shooting, as per department protocol.

 

Two investigations will be conducted: the special investigations unit and the Travis County district attorney’s office will handle the criminal aspects, while the internal affairs unit and the office of police oversight will review police conduct.
