Wheat Ridge Police announced on Wednesday that they would not pursue charges related to the tragic accident on Interstate 70 near Ward Road that resulted in the deaths of three individuals.
According to a Facebook post from the Wheat Ridge Police Department, an investigation revealed no probable cause for criminal charges following the incident that occurred on August 15. “Our department made it a priority to deliver this news to the victims’ family and walk them through the facts of the investigation, before announcing this to the public,” the post stated. “This was a tragic, heartbreaking accident, and we want to give this family our full support.”
The inquiry was conducted in collaboration with experts from the 1st Judicial District Attorney’s Office, and both teams concluded that substantial evidence indicated no crime was committed during the crash.
The investigation involved an extensive review of data, video footage, environmental conditions at the scene, and inspections of the truck involved. The truck had been inspected just a month prior to the crash, showing no problems. It was also confirmed to be about 8,000 pounds under the weight limit when the driver stopped at a weigh station approximately 40 minutes before the accident. Additionally, the truck was adequately secured with straps for the 100 plastic pipes it was transporting, and infrared scans indicated no brake failures.
Data retrieved from the truck’s black box and other sources showed the driver was traveling at 59 mph in a zone where the speed limit was 60 mph, and there were no signs of impairment.
On the morning of August 15, the truck, which was carrying pipes weighing around 500 pounds each, overturned, spilling its load onto the westbound lanes of I-70 and colliding with several vehicles. Among the five occupants of one vehicle, three were fatally injured, while the other two were hospitalized.
The Jefferson County Coroner’s Office identified the deceased as Ruben Rodriguez Garcia, 32, Sindy Plata Martinez, 39, and Luz Martinez, 60. Ruben and Sindy had recently married the Saturday before the accident, and Luz was Sindy’s mother visiting from Colombia. Her husband and the couple’s young son survived the incident. The truck driver was also taken to a hospital for treatment and was later released.
Wheat Ridge Police stated that the incident involved at least seven vehicles, including the semi-truck, and described it as a series of crashes. The investigation into the matter is now officially closed.
