An inquest jury has determined that Daniela Espirito Santo, a 23-year-old mother, was unlawfully killed hours after she reported an assault by her partner to the police. Daniela was found unconscious at her home in Chestnut Grove, Grantham, Lincolnshire, following her call to authorities about the incident involving her then-partner, Julio Jesus, who had been released on bail.
The jury delivered its verdict during the inquest held at Lincoln Coroner’s Court, concluding that she died due to “severe emotional stress” stemming from the assault, which resulted in sudden cardiac death. The hearing revealed that shortly before midnight on April 8, 2020, Daniela dialed 999 but was instructed by the police call-handler to call 101 instead. After being on hold for eight minutes, the handler could only hear the cries of her six-month-old baby when her call was finally answered.
An ambulance was dispatched to her residence, but despite attempts to revive her, Daniela was pronounced dead at 12:58 a.m. The jury found that she had a pre-existing heart condition called myocarditis, and her death that night was due to myocardial insufficiency triggered by the altercation.
Following the investigation, police interviews with Mr. Jesus revealed that he was “fully aware” of the seriousness of Daniela’s health condition and its potential dangers. Prior to her death, Daniela had reached out to Lincolnshire Police multiple times between May 2019 and April 2020 to report the domestic abuse she suffered at the hands of Mr. Jesus.
He had been arrested on April 8, the day before her death, after allegedly restraining Daniela by pinning her down and choking her. The Chief Constable of Lincolnshire Police, Paul Gibson, expressed apologies to Daniela’s children, family, and friends for the suffering they have endured and acknowledged areas where the police could have acted more effectively.
