Xavier Perez, a 27-year-old man, was fatally shot outside a basketball gym in San Antonio back in April, with three men now facing murder charges in connection with the incident. Reports suggest that the shooting may have been a case of mistaken identity.
The tragic event occurred shortly after midnight on April 26 at the Brooks Inner-City Sports facility located on Topeka Boulevard near Interstate 37. According to the arrest affidavit, Perez’s brother informed investigators that prior to the shooting, one of the suspects, Justin Eaton, had made threats against a family member. The brother expressed his belief that Perez was mistaken for someone else due to their similar appearance.
On the night of the incident, surveillance footage captured a gray or silver SUV arriving at the gym, from which two passengers opened fire on Perez as he stood between his truck and a friend’s vehicle. After Perez fell to the ground, one passenger approached him while the other continued to shoot.
Eight hours following the shooting, detectives from the San Antonio Police Robbery Unit reported tracking a stolen silver Mitsubishi Outlander SUV, matching the vehicle seen in the surveillance footage. The SUV was observed circling the gym area prior to the shooting. Additionally, gunfire was reported nearby shortly after the incident, and ballistic evidence linked the bullets recovered from that scene to the shell casings found at the murder location.
On May 7, two of the suspects, Glen McGarity and Diontay Roberson, were arrested in connection with a robbery of a Brinks armored truck, which led authorities on a high-speed chase. During their arrest, detectives seized their cell phones, which provided crucial information regarding the SUV’s movements prior to the shooting.
Investigators noted that Eaton himself sustained a gunshot wound during the incident, believed to have been inflicted by one of the other suspects, as he was the only one firing during the attack.
