Fatal Polk County shooting death of Kelly Agar Garcia – Obituary

Kelly Agar Garcia, 43, died after fatally shooting his adult stepson during an argument in Davenport, Florida, on Wednesday night. The incident unfolded around 7 p.m. at the family home, where a dispute over the younger brother’s use of the video game Fortnite escalated tragically.

 

According to police reports, Garcia’s wife and her three sons, ages 9, 11, and 26, were at home when the youngest boy was caught playing Fortnite against his parents’ rules. After his cellphone was confiscated, the 9-year-old retrieved a 9mm handgun from their bedroom. A struggle ensued between the parents and the boy, during which Garcia managed to take control of the firearm.

 

The situation worsened when the stepson, Azareel J. Martinez, 26, entered the room and noticed the 9-year-old’s agitated state. An argument broke out between Garcia and Martinez, leading Garcia to shoot Martinez multiple times in the chest and abdomen. As Martinez attempted to leave, Garcia fired additional shots into his back, resulting in his death.

 

Emergency services transported Martinez to a hospital, where he was pronounced dead. Kelly Agar Garcia was arrested at the scene and charged with second-degree murder and unlawful storage of a firearm. He is currently held in the Polk County Jail. The investigation into the circumstances of the shooting remains ongoing.
