Family members of Daryl Evans are pushing for increased charges against Barbara Jean Blue, the woman accused of his fatal shooting earlier this year.
During a press conference held on Monday outside the Fort Bend County Criminal Justice Center, they urged for the current aggravated assault with a deadly weapon charge against the 75-year-old Blue to be elevated to murder.
The Evans family claimed that Blue had been harassing them since they moved into their home 13 years ago.
Blue has contended that it was Daryl who had been harassing her for years, asserting that he cursed and threatened her on the day of the shooting. She claimed she fired her weapon out of fear for her safety.
An attorney representing the Evans family argued that Blue’s past actions indicate that the shooting was not an act of self-defense. The lawyer called for the charge to be upgraded and an additional charge to ensure accountability.
Blue made her initial court appearance on Monday and is currently out on a $400,000 bond.
The Evans family also accused the neighborhood association of condoning Blue’s behavior, planning to file a civil lawsuit against the association for their alleged complicity.
However, an attorney for the neighborhood association disputed the connection, noting that Blue was not an official member of the board and that the shooting did not occur on association property.
On Thursday, June 27, Tammy Evans recounted that she and her husband, Daryl, had just returned home with food when Blue blocked their path along Baybriar Drive, near the Fort Bend Parkway Toll Road and south of W. Fuqua Street in Missouri City. Moments later, Tammy reported, gunshots were fired, resulting in the death of her 66-year-old husband.
Tammy also claimed that Blue threatened to shoot her as she was speaking with dispatchers. Although Daryl was still alive when he left their longtime neighborhood, he succumbed to his injuries the following morning after two surgeries.
Tammy and other residents described the shooting as the culmination of years of disputes with Blue, who had repeatedly complained about noise and children playing. Tammy stated that since moving to their home 13 years ago, she and Daryl had faced continuous harassment from Blue, who allegedly filmed their activities and brandished a handgun.
